Terms of Service

Draft – have this reviewed by a lawyer before launch. Last updated: [DATE]. The German version is legally binding.

1. Provider and scope

Pontumi is operated by UFMOSA UG (haftungsbeschränkt), Bellevuestraße 1, 10785 Berlin ("we"). These terms apply to all contracts for using Pontumi with consumers and businesses.

2. The service

Pontumi is a web workspace that gives access to AI models from several providers (including OpenAI, Anthropic, Google, Mistral AI, xAI and Microsoft) through their official APIs. We are independent and not affiliated with these providers. A plan does not include any provider's consumer subscription (such as ChatGPT Plus or Claude Pro).

The available models can change, for example when a provider retires a model or is temporarily unavailable. Where possible we replace retired models with equivalent ones.

AI answers can be wrong. They are not legal, tax, medical or financial advice. Check important results yourself.

3. Account

You need an account to use Pontumi. Keep your credentials secret. An account is for one person.

4. Plans and credit

Each plan includes AI credit in euros per billing period. Each request uses credit according to the tokens the provider actually counted and the prices shown in the workspace. The price of every answer is shown under the answer.

Free trial credit can be used once per person.

5. Prices and payment

Prices are shown on the website and include VAT. Plans are billed monthly in advance through Stripe and renew automatically for one month until cancelled. A plan becomes active once Stripe confirms payment. When you move to a higher plan, the difference is charged and credited pro rata.

6. Term and cancellation

You can cancel at any time, effective at the end of the current billing period – in your account, through the Stripe customer portal, or without signing in via Cancel contract. The right to terminate for good cause is unaffected.

7. Right of withdrawal for consumers

[TO COMPLETE: withdrawal notice and model withdrawal form under Art. 246a EGBGB.] At checkout you expressly request that we start the service before the withdrawal period ends and confirm that you know the right of withdrawal expires once the contract is fully performed (§ 356(4) BGB).

8. Acceptable use

Not allowed: breaking the law; violating the model providers' usage policies; attacking or overloading the service; automated bulk access; reselling or sharing access without our written permission. We may suspend accounts that do.

9. Your content

Your inputs and the answers belong to you as far as the law allows. You grant us only the rights needed to provide the service (storing, sending to the chosen provider, displaying).

10. Liability

[TO COMPLETE: unlimited liability for intent, gross negligence, injury to life, body or health, and under the Product Liability Act; for slightly negligent breach of essential obligations, limited to foreseeable, contract-typical damage; otherwise excluded.]

11. Changes

We may change these terms for the future. We will notify you by email at least six weeks in advance; if you don't object, the changes are deemed accepted. The notice will point out your right to object. [TO CHECK]

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this applies only insofar as it doesn't remove mandatory consumer protection of their country of residence. Place of jurisdiction for merchants is Berlin.
